SMS/Text Messaging Policy

This SMS/Text Messaging Policy applies to text messages, SMS messages, MMS messages, mobile messages, and related messaging services sent by or on behalf of SiteEngine Web Services LLC, a Florida limited liability company, doing business as SiteEngine, North Georgia Web, and North Florida Web (“SiteEngine,” “we,” “us,” or “our”).

This policy applies to messages sent to customers, prospective customers, account users, authorized contacts, vendors, and other individuals who provide a mobile telephone number to SiteEngine or otherwise consent to receive messages from SiteEngine.

This policy supplements the SiteEngine Terms of Service, User Agreement, Privacy Notice, Email and Messaging Terms, Anti-SPAM Policy, and any applicable quote, invoice, proposal, statement of work, or signed agreement.

1. Program Description

SiteEngine may send SMS, MMS, or text messages related to website services, hosting services, managed WordPress services, support requests, billing, appointments, service notices, account notices, security notices, domain notices, project updates, sales inquiries, and marketing messages where permitted.

Messages may include transactional, informational, service-related, account-related, support-related, billing-related, security-related, and promotional communications.

SiteEngine’s messaging program is intended for business communications between SiteEngine and people who have provided their phone number to SiteEngine or who otherwise have a business relationship, inquiry, account, or service interaction with SiteEngine.

2. Brand Identification

Messages from SiteEngine should identify SiteEngine or otherwise make clear that the message is from or on behalf of SiteEngine.

Example message formats may include:

  • “SiteEngine: Your support request has been updated. Reply STOP to opt out.”
  • “SiteEngine: Your website maintenance appointment is scheduled for [date/time]. Reply HELP for help or STOP to opt out.”
  • “SiteEngine: Your invoice is due on [date]. Please log in to your account for details. Reply STOP to opt out.”
  • “SiteEngine: We received your website quote request. Reply HELP for help or STOP to opt out.”

3. Consent to Receive Messages

By providing a mobile telephone number to SiteEngine and opting in where required, you authorize SiteEngine to send SMS, MMS, or text messages to that number.

You may provide consent through website forms, quote request forms, contact forms, service signup forms, checkout forms, client portal forms, written agreements, email communications, support tickets, verbal requests, or other interactions where you provide a mobile number and authorize SiteEngine to contact you.

Consent to receive marketing text messages is not required as a condition of purchasing any SiteEngine service.

Where SiteEngine requests consent for marketing text messages, the consent request should be clear, optional, and separate from other required transaction terms where legally required.

4. Service-Related Messages

SiteEngine may send service-related text messages about active or requested services. These may include support updates, appointment reminders, project updates, maintenance notices, outage notices, billing notices, domain renewal reminders, security alerts, account verification messages, and other operational communications.

Service-related messages are intended to help SiteEngine provide, manage, secure, or support your account or services.

Opting out of text messages may limit SiteEngine’s ability to send certain service-related notices by SMS. You remain responsible for monitoring email, invoices, the client portal, domain renewals, and other account communications.

5. Marketing Messages

SiteEngine may send promotional or marketing text messages only where SiteEngine believes it has appropriate consent or another legally permitted basis to do so.

Marketing messages may include promotions, service offers, renewal offers, seasonal offers, referral program notices, announcements, or related business communications.

Marketing text consent is optional. You may opt out of marketing text messages at any time.

6. Message Frequency

Message frequency varies based on your relationship with SiteEngine, active services, support activity, billing activity, project status, appointment activity, security events, domain activity, and communication preferences.

For most customers, message frequency is expected to be occasional and based on service activity.

Marketing message frequency may vary but is generally limited to periodic SiteEngine service announcements, offers, or follow-ups where permitted.

7. Message and Data Rates

Message and data rates may apply.

Your mobile carrier may charge you for messages, data usage, or other mobile services according to your mobile plan. SiteEngine is not responsible for carrier charges, data charges, message charges, or other fees charged by your mobile provider.

8. Opt-Out Instructions

You may opt out of receiving text messages from SiteEngine at any time by replying STOP to a SiteEngine text message where supported.

You may also request opt-out by contacting SiteEngine at support@siteengine.io or by calling (850) 368-9833.

After you opt out, SiteEngine may send one confirmation message to confirm that your opt-out request has been processed.

SiteEngine will honor opt-out and revocation requests as required by applicable law, carrier rules, and messaging-provider rules.

9. Additional Revocation Methods

SiteEngine will make reasonable efforts to honor clear revocation requests made by other reasonable methods, including requests that use words or phrases such as “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel,” or “unsubscribe,” where the request can be reasonably identified and associated with your mobile number or account.

If your opt-out request is unclear, SiteEngine may request clarification or additional information needed to identify the affected number, account, or messaging program.

Revoking text-message consent does not cancel your SiteEngine services, eliminate amounts owed, cancel invoices, cancel domain renewals, cancel support requests, or terminate any separate agreement.

11. Supported Carriers and Delivery

Message delivery is not guaranteed.

SMS and MMS delivery may depend on your mobile carrier, device, number status, network availability, messaging provider, carrier filtering, campaign registration, phone settings, and other factors outside SiteEngine’s control.

Carriers, aggregators, and messaging providers are not liable for delayed or undelivered messages.

SiteEngine does not guarantee message delivery, delivery timing, carrier approval, carrier support, device compatibility, or uninterrupted availability of SMS or MMS services.

12. No Sharing or Sale of SMS Consent

SiteEngine does not sell SMS consent, text-message opt-in data, or mobile telephone numbers collected for SMS messaging.

SiteEngine does not share SMS opt-in consent or SMS opt-in data with third parties for their independent marketing purposes.

SiteEngine may share information with service providers, messaging platforms, carriers, aggregators, support vendors, compliance vendors, and other vendors as needed to operate the messaging program, deliver messages, maintain records, prevent fraud or abuse, comply with law, or provide SiteEngine services.

13. Privacy

SiteEngine’s collection, use, disclosure, and retention of personal information is described in the SiteEngine Privacy Notice.

Information related to text messaging may include your name, business name, mobile number, consent status, opt-in source, opt-in timestamp, opt-out status, message history, delivery status, carrier information, support history, and account information.

SiteEngine may retain messaging records as needed for service delivery, compliance, consent verification, dispute resolution, fraud prevention, security, support, legal obligations, and legitimate business purposes.

14. User Responsibilities

You agree to provide only mobile numbers that you own, control, or are authorized to use.

You agree not to provide another person’s phone number without authorization.

You agree to notify SiteEngine if your mobile number changes, is transferred, is reassigned, is no longer used by you, or should no longer be associated with your account.

You are responsible for keeping your account contact information accurate and current.

15. Number Changes and Reassigned Numbers

If you change or deactivate your mobile number, you must notify SiteEngine promptly.

SiteEngine is not responsible for messages sent to a number that you provided if you fail to notify SiteEngine that the number has changed, been reassigned, or should no longer receive messages.

SiteEngine may remove, suppress, or update mobile numbers if we determine that a number is invalid, reassigned, unreachable, opted out, or associated with complaints or delivery failures.

16. Prohibited Use of SiteEngine Messaging

You may not use SiteEngine services, forms, systems, or integrations to send, facilitate, or request unlawful, abusive, deceptive, fraudulent, harassing, infringing, or non-compliant text messages.

Prohibited messaging includes phishing, spam, deceptive offers, impersonation, malware links, credential theft, unlawful marketing, messages to people who have not consented where consent is required, messages to opted-out recipients, and messages that violate carrier, provider, platform, or legal requirements.

SiteEngine may suspend or restrict messaging-related services if we determine that activity creates legal, carrier, platform, security, deliverability, reputational, or operational risk.

17. Client Messaging Campaigns

If SiteEngine assists a client with SMS setup, SMS registration, Twilio configuration, A2P 10DLC registration, toll-free verification, campaign setup, form opt-in language, CRM messaging, or similar client messaging activity, the client remains responsible for the legality and compliance of its own messaging program.

Clients are responsible for consent collection, consent records, message content, campaign descriptions, sample messages, opt-out handling, privacy notices, terms, support responses, carrier compliance, and compliance with TCPA, CAN-SPAM where applicable, state laws, carrier rules, Twilio policies, and other provider requirements.

SiteEngine may provide technical implementation assistance, but SiteEngine does not provide legal advice and does not guarantee carrier approval, Twilio approval, campaign approval, message delivery, or regulatory compliance.

18. A2P 10DLC, Toll-Free, and Provider Registration

Business SMS messaging may require brand registration, campaign registration, toll-free verification, use-case disclosure, sample messages, opt-in disclosure, privacy-policy links, terms links, business identity verification, or other provider-required information.

You are responsible for providing accurate and complete registration information if SiteEngine assists with registration or configuration.

SiteEngine may refuse to submit, modify, or support messaging campaigns that appear inaccurate, misleading, non-compliant, unsupported, high-risk, or inconsistent with provider requirements.

Provider approval is not guaranteed. Providers, carriers, aggregators, and messaging platforms may reject, suspend, filter, block, limit, or terminate messaging campaigns or numbers at their discretion.

19. Opt-In Disclosure Example

SiteEngine may use opt-in language substantially similar to the following where appropriate:

Where marketing text messages are requested, SiteEngine may use a separate optional marketing consent checkbox or other consent mechanism where required.

20. Sample Message Types

SiteEngine messages may include messages substantially similar to the following:

  • “SiteEngine: We received your website quote request. Reply HELP for help or STOP to opt out.”
  • “SiteEngine: Your support ticket has been updated. Please check your email or client portal. Reply STOP to opt out.”
  • “SiteEngine: Your website maintenance appointment is scheduled for [date/time]. Reply HELP for help or STOP to opt out.”
  • “SiteEngine: Your invoice is due on [date]. Please log in to your account for details. Reply STOP to opt out.”
  • “SiteEngine: Security notice for your website account. Please check your email or client portal. Reply HELP for help or STOP to opt out.”

21. Message Content

SiteEngine messaging content must be accurate, lawful, non-deceptive, and consistent with the purpose for which consent was obtained.

SiteEngine does not use SMS messages to request passwords, full payment card numbers, Social Security numbers, or other highly sensitive information.

If you receive a suspicious message claiming to be from SiteEngine, contact abuse@siteengine.io or support@siteengine.io.

22. Security and Abuse

SiteEngine may monitor, log, review, filter, suspend, or restrict messaging activity as needed to operate services, respond to support requests, investigate abuse, prevent fraud, maintain compliance, protect infrastructure, or comply with law or provider requirements.

SiteEngine may report abusive, fraudulent, unlawful, or suspicious messaging activity to carriers, messaging providers, platforms, law enforcement, regulators, security vendors, or affected parties where appropriate.

23. Fees and Charges

SiteEngine does not charge recipients a separate fee to receive SiteEngine text messages, but message and data rates may apply from the recipient’s mobile carrier.

If SiteEngine provides SMS setup, messaging configuration, Twilio setup, A2P registration assistance, campaign management, technical implementation, troubleshooting, compliance review, or related client services, those services may be billable under the applicable invoice, proposal, statement of work, or service agreement.

24. Changes to This Policy

SiteEngine may update this SMS/Text Messaging Policy from time to time. Updated versions will be posted on our website with a revised “Last updated” date.

Your continued participation in SiteEngine’s SMS/Text messaging program after updated terms are posted means you accept the updated policy.
