Email and Messaging Terms

These Email and Messaging Terms apply to business email, transactional email, form notifications, SMTP configuration, DNS-based email authentication, email routing, mailbox-related assistance, marketing email assistance, SMS-related technical services, and messaging-related support provided by SiteEngine Web Services LLC, a Florida limited liability company, doing business as SiteEngine, North Georgia Web, and North Florida Web (“SiteEngine,” “we,” “us,” or “our”).
These terms supplement the SiteEngine Terms of Service, User Agreement, Acceptable Use Policy, Anti-SPAM Policy, SMS/Text Messaging Policy, Privacy Notice, and any applicable quote, invoice, proposal, statement of work, or signed agreement.
If there is a conflict between these terms and a signed written agreement between you and SiteEngine, the signed written agreement controls for that specific service or engagement.
1. Service Scope
Email and messaging services may include DNS record configuration, mailbox setup assistance, transactional mail configuration, form notification setup, SMTP configuration, SPF, DKIM, DMARC, MX record assistance, email routing assistance, email migration assistance, deliverability troubleshooting, or messaging-related technical support, depending on the service purchased.
Only items expressly included in your active plan, proposal, invoice, service description, support ticket, statement of work, or written agreement are included.
SiteEngine does not provide unlimited email administration, mailbox management, end-user device support, email client troubleshooting, list management, marketing campaign management, or email compliance services unless expressly included in the approved scope.
2. Third-Party Email and Messaging Providers
Email and messaging services may depend on third-party providers, including mailbox providers, SMTP providers, transactional email providers, DNS providers, spam-filtering providers, email marketing platforms, CRM systems, form plugins, SMS platforms, carriers, aggregators, and other vendors.
SiteEngine does not control third-party providers and is not responsible for their availability, security, deliverability, pricing, licensing, billing, policies, filtering decisions, account restrictions, API behavior, outages, data processing, or support.
If a third-party provider changes pricing, policies, features, approval requirements, authentication requirements, API access, account status, or service availability, resulting work may be billable unless expressly included in your active plan.
3. Deliverability
Email deliverability depends on many factors outside SiteEngine’s control, including sender reputation, domain reputation, IP reputation, DNS authentication, message content, list quality, sending behavior, bounce rates, complaint rates, spam traps, blacklists, recipient servers, spam filters, mailbox provider policies, user behavior, and third-party provider decisions.
SiteEngine does not guarantee inbox placement, delivery to all recipients, open rates, click rates, reply rates, conversion rates, uninterrupted sending, uninterrupted receiving, or avoidance of spam filtering.
Deliverability assistance, reputation repair, blacklist review, DMARC alignment, DNS authentication review, bounce analysis, or provider coordination may be billable unless expressly included in your active plan.
4. DNS Authentication Records
Email authentication may require DNS records such as SPF, DKIM, DMARC, MX, CNAME, TXT, return-path, bounce-domain, verification, or provider-specific records.
DNS changes can affect email delivery, website verification, third-party platforms, marketing tools, transactional mail, CRM systems, and other services.
You are responsible for identifying all email providers and platforms that send mail on behalf of your domain before DNS changes are made.
SiteEngine is not responsible for delivery issues caused by incomplete, inaccurate, conflicting, externally managed, unauthorized, or delayed DNS records unless caused solely by SiteEngine’s gross negligence or willful misconduct.
5. SPF, DKIM, and DMARC
SiteEngine may assist with SPF, DKIM, and DMARC configuration if included in your service plan or approved as billable work.
SPF, DKIM, and DMARC settings may affect whether email is accepted, rejected, quarantined, marked as spam, aligned with sending domains, or reported by receiving providers.
Strict DMARC policies may cause legitimate email to fail if all sending systems are not properly authenticated and aligned.
You are responsible for identifying all legitimate sending services before a restrictive DMARC policy is implemented.
6. Business Email and Mailboxes
Business email or mailbox assistance may include setup, DNS routing, connection assistance, or basic configuration if included in scope.
Unless expressly included, SiteEngine is not responsible for mailbox backups, mailbox exports, deleted email, archived email, local mail clients, mobile device setup, desktop mail software, user-side filtering rules, user-created forwarding rules, mailbox cleanup, shared mailbox administration, or email retained outside SiteEngine-controlled systems.
You are responsible for maintaining mailbox credentials, user access, device security, mailbox organization, retention policies, and backup practices appropriate for your business.
7. Transactional Email
Transactional email may include form notifications, password reset messages, order confirmations, account notices, system notifications, support notifications, or other service-related messages.
Transactional email may depend on WordPress, plugins, themes, SMTP services, DNS records, hosting configuration, third-party APIs, recipient servers, and provider policies.
SiteEngine does not guarantee that transactional messages will be delivered, received, opened, or acted upon.
You are responsible for periodically testing important forms, notification flows, checkout emails, account emails, and other business-critical email workflows.
8. Forms and Website Notifications
Website forms and notifications may be affected by form plugin settings, SMTP configuration, spam protection, CAPTCHA, DNS authentication, CRM integrations, webhook delivery, email filtering, recipient server rules, and third-party outages.
SiteEngine may assist with form notification configuration if included in scope, but does not guarantee delivery of every form notification or lead notification.
You are responsible for regularly checking your website, CRM, form-entry storage, spam folders, lead inboxes, and backup notification paths.
SiteEngine is not responsible for lost leads, missed messages, lost revenue, customer claims, or business interruption caused by form-delivery failures or email-filtering behavior except to the limited extent stated in a signed written agreement.
9. Marketing Email
Marketing email assistance may include technical setup, DNS authentication, platform configuration, template assistance, or campaign support if expressly included in the approved scope.
You are responsible for lawful marketing email practices, including consent, list quality, unsubscribe handling, suppression lists, accurate sender information, truthful subject lines, mailing-address disclosure, and compliance with applicable laws and platform rules.
You may not use SiteEngine services for spam, deceptive email, purchased-list blasts, harvested-list campaigns, phishing, spoofing, malware links, or abusive messaging.
Marketing email activity is also governed by the SiteEngine Anti-SPAM Policy.
10. SMS and Text Messaging
SMS, text messaging, mobile messaging, and related technical services are governed by the SiteEngine SMS/Text Messaging Policy in addition to these Email and Messaging Terms.
SMS services may depend on third-party messaging platforms, carriers, aggregators, phone-number providers, consent records, campaign registration, carrier filtering, and applicable law.
SiteEngine does not guarantee SMS delivery, timing, carrier approval, campaign approval, uninterrupted messaging, deliverability, or compatibility with all devices or carriers.
You are responsible for consent, opt-out handling, message content, required disclosures, list quality, number ownership, and compliance with applicable SMS, TCPA, carrier, platform, and marketing rules.
11. Consent, Opt-Outs, and Suppression
You are responsible for maintaining appropriate consent records, unsubscribe mechanisms, opt-out handling, suppression lists, and preference-management practices for email and messaging activity.
You may not continue sending marketing messages to recipients who have opted out, revoked consent, complained, bounced repeatedly, or otherwise indicated that they do not want to receive messages.
SiteEngine may require evidence of consent, list source, suppression practices, or compliance before assisting with email or messaging services.
12. Prohibited Messaging Activity
You may not use SiteEngine services, systems, domains, DNS records, hosting, forms, SMTP configuration, or third-party integrations to send, facilitate, or support:
- Spam or unsolicited bulk email.
- Purchased-list campaigns.
- Harvested-list campaigns.
- Phishing messages.
- Malware links.
- Credential theft.
- Spoofed or deceptive sender identities.
- Misleading subject lines.
- Fraudulent offers.
- Messages that violate CAN-SPAM, TCPA, carrier rules, email-provider rules, platform rules, or applicable law.
- Messages that create abuse complaints, blacklist risk, carrier filtering, or reputational harm.
13. Suspension and Restriction
SiteEngine may suspend, restrict, throttle, disable, or terminate email or messaging services if they generate abuse complaints, spam reports, blacklist risk, carrier filtering, excessive bounce rates, fraud concerns, legal risk, third-party provider restrictions, platform-policy issues, compromised account activity, malware, phishing, or reputational harm.
SiteEngine may also suspend or restrict email or messaging services for nonpayment, failed payment, chargeback, inaccurate account information, suspected unauthorized use, or violation of SiteEngine policies.
SiteEngine is not liable for consequences of good-faith suspension, restriction, throttling, filtering, or termination of email or messaging services.
14. Blacklists and Reputation
Domains, IP addresses, email addresses, mail servers, links, tracking domains, or sending providers may be blacklisted, filtered, blocked, rate-limited, or reputation-scored by third parties.
SiteEngine does not control third-party blacklists, spam filters, recipient servers, mailbox providers, or reputation systems.
Blacklist investigation, reputation review, delisting requests, DNS changes, content review, sending-pattern review, or provider coordination may be billable unless expressly included in your active plan.
15. Shared Infrastructure and Reputation Protection
Some email, hosting, DNS, or messaging services may use shared infrastructure, IP addresses, domains, or vendor systems.
Activity that harms shared reputation, deliverability, IP space, sender reputation, platform standing, or vendor relationships may affect SiteEngine and other customers.
SiteEngine may take immediate action to protect shared infrastructure, including disabling scripts, disabling forms, suspending email, restricting sending, removing malware, blocking traffic, requiring DNS changes, or terminating services.
16. Security and Compromised Accounts
You must promptly notify SiteEngine if you suspect unauthorized access, mailbox compromise, SMTP credential compromise, phishing, malware, suspicious forwarding rules, suspicious sending, account takeover, or other security issue.
SiteEngine may reset passwords, disable accounts, revoke credentials, disable forwarding, suspend sending, quarantine messages, remove scripts, disable forms, update DNS records, or take other protective action if we believe an email or messaging system is compromised or abused.
Security remediation, forensic review, mailbox cleanup, blacklist remediation, password rotation, and restoration may be billable unless expressly included in your active plan.
17. Mailbox Data, Retention, and Backups
Unless expressly included in a signed written agreement, SiteEngine does not guarantee backup, retention, restoration, export, or recovery of mailbox data.
Email may be deleted, filtered, archived, quarantined, overwritten, retained, or lost depending on mailbox settings, provider rules, user behavior, retention policies, device settings, local mail clients, synchronization settings, account status, or third-party systems.
You are responsible for maintaining independent backups and retention policies for business-critical email.
18. Email Migration
Email mailbox migration is not included unless expressly stated in the approved scope.
Email migration may be affected by provider limitations, mailbox size, folder structure, authentication, throttling, message corruption, deleted items, archives, calendar data, contacts, shared mailboxes, permissions, labels, filters, and client-side settings.
SiteEngine does not guarantee perfect email migration, preservation of all messages, preservation of all metadata, preservation of folder structure, preservation of read/unread status, or uninterrupted email access during migration.
19. User Devices and Email Clients
Unless expressly included in scope, SiteEngine does not provide support for local devices, desktop mail clients, mobile mail clients, operating systems, user-side filters, browser extensions, antivirus tools, or network settings.
Client-side email issues may be caused by device settings, cached passwords, outdated software, local storage, security tools, network restrictions, or user configuration.
SiteEngine may provide general configuration information, but device-specific or user-side troubleshooting may be billable or outside scope.
20. Confidentiality and Sensitive Information
Email and messaging systems may contain confidential, personal, financial, medical, legal, employment, or regulated information.
You are responsible for determining whether the email or messaging services you use are appropriate for the type of information you send, receive, store, or process.
Unless expressly agreed in a signed written agreement, SiteEngine services are not designed for HIPAA-regulated protected health information, PCI cardholder data storage, government classified information, or other highly regulated data.
21. Legal and Regulatory Compliance
SiteEngine does not provide legal advice regarding CAN-SPAM, TCPA, privacy law, marketing law, employment law, healthcare law, financial regulation, consumer protection, accessibility, or other legal obligations.
SiteEngine may assist with technical implementation at your direction, but you are responsible for determining legal obligations and obtaining appropriate legal or compliance advice.
You are responsible for your email and messaging content, consent practices, opt-out practices, list sources, disclosures, privacy notices, retention practices, and customer communications.
22. Service Changes
SiteEngine may modify, replace, discontinue, migrate, reconfigure, or remove email or messaging services, providers, settings, DNS records, authentication methods, sending limits, routing methods, or support processes when SiteEngine determines that doing so is appropriate for security, deliverability, stability, cost, vendor availability, or operational reasons.
SiteEngine will use commercially reasonable efforts to avoid unnecessary disruption, but does not guarantee that any provider, feature, IP address, sending method, routing method, mailbox platform, SMTP provider, or messaging tool will remain available indefinitely.
23. No Guarantee of Outcome
SiteEngine does not guarantee email delivery, inbox placement, open rates, click rates, replies, conversions, sales, leads, campaign approval, SMS delivery, carrier approval, uninterrupted email access, uninterrupted messaging, mailbox recovery, blacklist removal, or reputation repair.
Email and messaging outcomes depend on many factors outside SiteEngine’s control, including third-party providers, recipient systems, spam filters, carrier networks, list quality, sender reputation, customer behavior, content, DNS, authentication, and applicable law.
24. Changes to These Terms
SiteEngine may update these Email and Messaging Terms from time to time. Updated versions will be posted on our website with a revised “Last updated” date.
Your continued use of SiteEngine email or messaging services after updated terms are posted means you accept the updated terms.
